By subscribing to any of our services, you are deemed to fully agree to these terms and must comply with all conditions and provisions.
01 – Subscription and Payment Terms for Our Services
Payment Mechanism: Our services are provided according to the following payment mechanism:

Client’s Own Hosting: The full amount must be paid in advance.

Hosting Reserved by Us (for projects exceeding 4,000 Saudi Riyals): Payment is made in two installments:
- First Installment (70%): Paid to commence the website build and services.
- Second Installment (30%): Paid after confirming the website is ready for operation.

Advantage of Full Payment: Full payment contributes to reducing the time required to complete the work, allowing for completion before the agreed-upon deadline.
02 – Nature of Work and Legal Structure (Skyweb)

Company Legal Status: Skyweb is not a commercially registered company, as it was de-registered from the commercial registry for economic reasons, as stated on the “About Us” page.

Work Documents: The Skyweb team operates under Freelance work documents accredited by the platform supporting freelance work.

Application of Terms: These terms apply to the contract and are fully attached to the payment invoice upon issuance.
Communication and Guarantees

Guaranteeing Client Rights: Skyweb is represented by individuals known to us in advance. You will be provided with all necessary information and documentation that guarantees the client’s rights related to the contract, which falls under the responsibility of the website owner.

Invoice and Contact Details: An electronic invoice specifying the requested services and the service provider’s details will be attached (also available on the “Contact Us” page along with our official announced numbers).

Security Alert: In case of any doubt or suspicion regarding individuals claiming to be associated with us, please do not deal with them and inform us immediately.
03 – General Terms of Service
Orders and Payment

Cancellation for Delayed Payment: The service request is automatically considered void if the required amount deposit is delayed for more than three days from the date of the request submission.

Service Suspension: We reserve the right to temporarily suspend the service in case of delayed payment of installments or remaining dues until the full amount is received.

Service Pricing: Prices are determined based on the total cost of the work required for the client’s project, in addition to any extra services requested to be included during the website or project build.

Non-Free Services: Skyweb does not provide any free services under any circumstances.
Software Nature and Hosting

Software Used: The software we provide is Open Source and well-known to developers, enjoying continuous support and updates from its owning companies. Due to the clear concept and specific objectives of this software, it does not require client meetings.

Development and Customization: The client can hire any technician or developer from anywhere in the world to develop or customize this software if they choose to contract with us.

Inquiry about Software and Hosting: If the client does not have prior knowledge of the software or hosting requirements, they can contact us for inquiries, request assistance from a specialist, or visit the dedicated help page on our website.
Cancellation, Refunds, and Domains

Paid Domains: Paid domains are absolutely non-refundable.

Hosting Space Refund (Client’s Own Hosting): You can request a refund for the amount paid for the hosting space only, within 30 days from the date of the request, without the need to state reasons. This is done through the client’s specific host.

Service Refund: Our services are non-refundable after 14 days from the date of order cancellation, except in the following cases:

If the service has not been implemented.

If the service does not comply with the agreed principles or generally accepted principles.

If we refuse to implement the service.

Ownership Rights and Technical Support

No Cloning of Websites: We categorically refuse any request to create a website identical to another client’s website. This right is guaranteed to clients and includes refusing to copy the design, content, or idea if it is specific and not general.

Delivery of Ready Websites: Ready websites are delivered in their current state, as seen by the client, with all their options and specifications. Any request to modify the design or add options after delivery requires separate payment of additional fees.

Subscription Renewal: Subscription to hosting space and domain is renewed annually. As for the services we provide, they are paid for only once.
04 – Post-Delivery Modifications (Free/Paid)

After 30 Days: Any modification requested after 30 days from the date of work handover is implemented for a fee.

After Warranty Expiration: After the basic six-month warranty period ends, the client can request technical support for their website or the provided service for a paid fee.
05 – Contracting and Communication

Dealing with the Client: Dealing with the client is based on the nomination of an individual with a Freelancer work document, who is introduced to the client by us via their specific contact numbers and email address, as stated on the “Contact Us” page.

Beneficiary Support: We provide services and support only to the original applicant, based on their information registered with us.
06 – Transactions and Liability Determination
Clarification of Scope and Cost

Pre-Clarification of Requests: The client must clearly explain the details of the request and how it should be presented before starting work and calculating the cost.

Requests Not Pre-Clarified: If additional requests arise that were not clarified in the initial agreement, the client will be informed of the necessity to calculate a new cost for them. The client has the right to accept or reject the new cost. In case of rejection, they have the right to a refund for the uncompleted service fees.

Right to Refusal: We reserve the right to refuse to continue providing a service to the client and to refund the value of the uncompleted service, if it cannot be provided for reasons such as high cost or technical incompatibility of the required programs.

Data Entry and Filling: We are not obligated to fill or enter the client’s data. If the client requests this service, its cost will be calculated separately, and the expected cost will be agreed upon and communicated to the client in advance.
Operation Guarantee and Cancellation

No Compensation: No compensation will be offered (other than the conditional refund mentioned previously) as long as the work is completed within the agreed-upon timeframe.

Completion Notice: The client will be notified before the agreed duration ends to enable them to complete their project or work as they see fit.

No Acceptance of Tampering: Any tampering or attempt to harm the service resulting from the client’s lack of technical knowledge will not be accepted. Necessary repairs in this case will only be conducted for a fee.

Inquiry about Misunderstanding: The client will be informed of any requests that indicate a misunderstanding of the product or service provided, and they will have the right to decide whether to continue the work or cancel it.
Client Responsibility and Administration

Administration Responsibility: The client is fully responsible for the administration of their website after delivery. If they lack the necessary knowledge, they must contract with a qualified technician to manage the website on their behalf.

Understanding the Product: Clients must try to understand the software or website as much as possible, especially since the website is available in Arabic.

Limits of Assistance: Assistance will be provided for general content understanding only. Otherwise, the client must visit technical support forums and articles related to the website for detailed information.

External Subscription Renewal: We are not obligated to renew any subscriptions related to paid (Premium) plugins or templates. The client must create a separate account to renew these resources.
External Programming and Accountability

Assistance with External Programming: When programming or services are requested from an external party (via WordPress or otherwise), we offer assistance in finding solutions for these requests, but we do not assume responsibility for the quality of the work provided by that external party.

Financial Disclaimer: We do not bear any financial responsibility or any agreement concluded between the client and the external provider. This service requires the client to provide guarantees to protect their rights in the manner they deem appropriate with the third party.
Conduct and Dispute Resolution

Mutual Respect: Transactions are based on mutual respect. Any abuse from the client grants us the right to cancel the transaction, while guaranteeing the preservation of both parties’ due financial rights.

Dispute Resolution: The client is not entitled to abuse or harm us for any reason (including their lack of knowledge or ignorance of the service). They must resort to the competent authorities and resolve disputes through legal and official channels. Otherwise, they will be responsible for any damage that may befall us as a result of such actions before the competent authorities.
07 – Disclaimer
Site Management and Data

Responsibility for Data and Content:

Data Accuracy: Skyweb is not responsible for the correctness or accuracy of the data entered by the client themselves on the website.

Content Type: The client bears full responsibility for the type of content they personally publish after the website handover. We categorically reject any content or practices that violate local and international laws, such as incitement to religion, politics, or hatred, publishing pornographic material, or selling prohibited materials.

Site Management After Handover:

All our clients’ websites (whether programmed or designed) are subject to the client’s exclusive management. We do not interfere in their operation or customer management, and the website owner bears full responsibility for their website based on this.

We retain the personal data entered by the client indefinitely in anticipation of any legal action we may be required to take.

Security, Maintenance, and Passwords

Passwords:

We do not retain the client’s files and passwords after the work handover. The client must keep them in a safe place.

We are not responsible for the loss of client passwords after delivery.

The client must change all their passwords immediately after receiving the work.

Warranty and Maintenance:

Any tampering by the client with the completed work automatically voids the warranty. The cost of repairing any tampering will be calculated separately.

The client is responsible for updating their website and its attachments and must take a backup copy before performing any upgrade or update.

08 – Responsibility for Hosting and External Parties
General Hosting Issues

General Hosting Issues: We are not responsible for any actions taken by the Host (Hosting Provider) to shut down the website due to malicious software or applications uploaded by the client.

The client must choose good hosting that supports WordPress and its plugins to avoid problems and ensure the quality of work. We do not bear any responsibility for the interruption or loss of work resulting from poor or interrupted hosting.

We do not bear responsibility for weak security caused by the client’s hosting or its cessation of work.
-
Client-Chosen Hosting: We do not bear responsibility for any actions taken by a host chosen by the client (not affiliated with or recommended by us). This includes the closure or loss of the website for any reason. The client must consult us and fully understand the terms and conditions of that service.

Site Closure due to Non-Payment: We are not responsible for the loss or closure of the client’s website by the host due to the non-payment of periodic fees.

Backup after Closure: We cannot provide a copy of the website after closure. The client must notify us in advance of their desire for a backup copy at least 30 days before the non-renewal date.
Disasters and Comprehensive Data Loss

Disasters and Force Majeure (Hostinger): In the worst-case scenario, Skyweb, through our partner (the hosting service provider), does not bear responsibility for the cost or effort of the client’s inputs resulting from the consequences of server or hosting downtime and the complete loss of work, due to:

Environmental disasters or fires leading to damage to the hosting and servers.

Company bankruptcy and complete cessation of its services.

Preventive Solution: The client must take a backup copy and place it on their own device or on a data storage cloud in anticipation of these circumstances beyond our control.

Purpose of Retaining Development Rights: We reserve the right to reference our work (Development Rights) on your website. This attribution reflects the quality of our services and enables us to provide you with better services in the future.

Client Options Regarding Attribution:

Removal: You have the right to remove our development rights from your website at any time.

Prior Notice Not to Place: You can notify us in advance of your desire not to place the attribution in a specific location, or not to place it at all.

Contracts and Subscription

Similar Contracts: By subscribing to one of our services, you may receive a contract that includes terms similar or identical to these General Terms.

Custom Contracts: A specific custom contract may be prepared and drafted for you, including additional and defined terms, adapted according to the type and nature of the service provided to you.
